Welcome to Ennovative Web Design (“we,” “us,” or “our”). These Terms and Conditions govern your use of our website design and development services. By engaging with our services, you (“Client,” “you,” or “your”) agree to comply with and be bound by these terms.

1. Services Provided
We offer website design, development, hosting, maintenance, and related digital services as agreed upon in a separate Project Proposal or Service Agreement. The scope of work, timelines, and pricing will be outlined in a written contract before project commencement.

2. Client Responsibilities
Provide all necessary content (text, images, logos, etc.) in a timely manner.

Designate a single point of contact for approvals and feedback.

Ensure all provided materials are legally owned or licensed for use.

Make timely payments as per the agreed schedule.

3. Payments & Fees
A non-refundable deposit (typically 30-50%) is required to begin work.

Remaining payments are due as per milestones outlined in the contract.

Late payments may incur interest (e.g., 5% per month) or pause project progress.

Additional work outside the agreed scope will be billed separately.

4. Revisions & Approvals
We include [X] rounds of revisions within the agreed scope.

Additional revisions may incur extra fees.

Delays in client feedback may extend project timelines.

5. Intellectual Property & Ownership
Upon full payment, the Client owns the final delivered website and design files.

We retain the right to display the work in our portfolio unless otherwise agreed in writing.

Any third-party assets (fonts, plugins, stock images) may have separate licenses.

6. Cancellation & Refunds
If the Client cancels the project:

Deposits are non-refundable.

Work completed up to cancellation will be billed.

If we terminate due to Client breach (e.g., non-payment, harassment), no refunds apply.

7. Website Hosting & Maintenance (If Applicable)
Hosting plans (if provided) require annual/monthly renewal.

Maintenance services (updates, backups, security) are billed separately unless included in a package.

We are not liable for website downtime due to third-party hosting issues.

8. Limitation of Liability
We are not liable for any losses due to website downtime, hacking, or data breaches beyond our control.

Maximum liability is limited to the total fees paid for the project.

9. Confidentiality
Both parties agree to keep project details confidential unless disclosure is required by law.

10. Governing Law
These Terms are governed by the laws of Australia, and any disputes shall be resolved in [Courts of Your Jurisdiction].

11. Changes to Terms
We may update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.
